“幸运飞艇害人不浅家破人亡”Thereremaintwoquestionsformetoexamine:thefirst,whetherasylumsofrefugearejust,andwhetherinternationalagreementsofextraditionareexpedientornot.Thereshouldbenospotwithintheboundariesofanycountryindependentofthelaws.Everycitizenshouldbefollowedbytheirpower,aseverysubstanceisfollowedbyitsshadow.Thereisonlyadifferenceofdegreebetweenimpunityandtherightofasylum;andastheeffectiveinfluenceofpunishmentconsistsmoreinitsinevitabilitythaninitsviolence,asylumsdomoretoinvitetocrimesthanpunishmentsdotodeterfromthem.Themultiplicationofasylumsistheformationofsomanypettysovereignties;forwheretherearenolawstocommand,thereitiseasyfornewlaws,opposedtothegenerallawsofacountry,tobeformed,andconsequentlyforaspiritopposedtothatofthewholecollectivesocialbodytoarise.AllhistoryshowsthatfromasylumshaveissuedgreatrevolutionsinStatesandintheopinionsofmankind.Butwhatevertendencymighthavebeenarisingintheoryorinpracticeaboutthistimetomitigatetheseverityofourlawswasdestinedtoreceiveadeadcheckfromthepublicationin1784and1785respectivelyoftwobookswhichdeservehistoricalrecollection.ThefirstwasMadan’s‘ThoughtsonExecutiveJustice,’inwhichtheauthor,adoptingBeccaria’sprincipleofthecertaintyofpunishmentasthebestcheckoncrime,advocatedanunflinchingcarryingoutofthelawsastheystood.‘Itwas,’saysRomilly,‘astrongandvehementcensureuponthejudgesandtheministersfortheirmodeofadministeringthelaw,andforthefrequencyofthepardonswhichtheygranted.Itwasverymuchread,andcertainlywasfollowedbythesacrificeofmanylives.’

WhythendidPietroVerrinotwriteithimself?Theanswerwouldseemtobe,outofdeferenceforthepositionandopinionsofhisfather.ItwassometimelaterthatGabrieldefendedtheuseoftortureintheMilaneseSenate,andPietrowroteaworkontorturewhichhedidnotpublishinhisfather’slifetime.Itwasprobablyduealsotothefather’spositionthatAlessandroheldhisofficeofProtectorofthePrisoners,sothattherewereobviousreasonswhichpreventedeitherbrotherfromundertakingtheworkinquestion.

Theotherbookwasfromamanwhomaboveallothersourforefathersdelightedtohonour.ThiswasArchdeaconPaley,whoin1785publishedhis‘MoralandPoliticalPhilosophy,’anddedicatedittothethenBishopofCarlisle.Noristhisfactofthededicationimmaterial,forthesaidBishopwasthefatherofthefutureLordChiefJusticeEllenborough,whoenjoysthemelancholyfameofhavingbeentheinveterateandsuccessfulopponentofnearlyeverymovementmadeinhistime,infavourofthemitigationofourpenallaws.ThechapteronCrimesandPunishmentsinPaleyandthespeechesofLordEllenboroughonthesubjectintheHouseofLordsare,inpointoffact,thesamething;sothatPaley’schapterisofdistincthistoricalimportance,asthe[55]chiefcauseoftheobstructionofreform,andasthebestexpressionofthephilosophyofhisday.IfothercountriesadoptedBeccaria’sprinciplesmorequicklythanourown,itwassimplythatthoseprinciplesfoundnoopponentsanywhereequaltoArchdeaconPaleyandhispupil,LordEllenborough.

Menopposethestrongestbarriersagainstopentyranny,buttheyseenottheimperceptibleinsect,whichgnawsthemaway,andmakesfortheinvadingstreamanopeningthatisallthemoresurebyveryreasonofitsconcealmentfromview.Inthesecondplace,alargeproportionofthehabitualcriminalclassisformedofweak-mindedorimbecilepersons,notoriousfortherepeatedcommissionofpettythefts,crimesofviolenceandpassion,andconfessedtobe‘notamenabletotheordinaryinfluencesofself-interestorfearofpunishment.’[57]Itisnowproposedtoseparatethisclassofprisonersfromothers;butispunishmentoperativeonthematall?Isnottheirproperplaceanasylum?

CHAPTERVII.PROOFSANDFORMSOFJUDGMENT.

ThereisnodoubtthatBeccariaalwayshadastrongpreferenceforthecontemplativeasopposedtothepracticalandactivelife,andthatbutforhisfriendPietroVerrihewouldprobablyneverhavedistinguishedhimselfatall.HewouldhavesaidwithPlatothatawisemanshouldregardlifeasastorm,andhidehimselfbehindawalltillitbeoverpast.Healmostdoessaythisinhisessayonthe‘PleasuresoftheImagination,’publishedsoonafterthe‘CrimesandPunishments.’Headviseshisreadertostandasideandlookonattherestofmankindastheyrunaboutintheirblindconfusion;tomakehisrelationswiththemasfewaspossible;andifhewilldothemanygood,todoitatthatdistancewhichwillpreventthemfromupsettinghimordrawinghimawayintheirownvortex.Lethiminhappycontemplationenjoyinsilencethefewmomentsthatseparatehisbirthfromhisdisappearance.Lethimleavementofight,[12]tohope,andtodie;andwithasmilebothathimselfandatthem,lethimreposesoftlyonthatenlightenedindifferencewithregardtohumanthingswhichwillnotdeprivehimofthepleasureofbeingjustandbeneficent,butwhichwillsparehimfromthoseuselesstroublesandchangesfromeviltogoodthatvexthegreaterpartofmankind.

Thequestion,therefore,arises,Doescrimedependtoanyappreciableextentonimprisonmentatall,oronthelengthorshortnessofsentences?

Inaperiodoftenyears,from1867to1876,thetotalnumberofprincipalindictableoffencescommittedinthemetropolisagainstproperty—andtheseconstitutethegreatmajorityofcrimes—were117,345.Buttheapprehensionsfortheseoffenceswereonly26,426,theconvictionsonly19,242.Inotherwords,[94]thechancesagainstapprehensionforsuchcrimesasburglaryorlarcenyarefourtooneinfavourofthecriminal,whilstthechancesagainsthisconvictionandpunishmentarefullyashighassixtoone.Whenwethusfindthatonly16percent.ofsuchcrimesreceiveanypunishment,theremaining84percent.escapingitaltogether,andthatonly22percent.areevenfollowedbyapprehension,weshallthemoreadmirethegeneralefficacyofourcriminalmachinery,inwhichpreventionbypunishmentplayssosmallapart.[51]

Paley,ofcourse,defendedthethinghefoundestablished;nor,consideringthesystemhehadtodefend,didhestatethecaseforitwithoutingenuity.Hehad,indeed,nothingtoaddtowhatBlackstonehadsaidregardingpunishment,namely,thatitwasinflicted,notinproportiontotherealguiltofanoffence,butinproportiontoitsfacilityofcommissionanddifficultyofdetection.Tostealfromashopwasnotmorecriminalthantostealfromahouse,but,asitwasmoredifficulttodetect,itwasmoreseverelypunished.Sheep,horses,andclothonbleaching-groundsweremoreexposedtothievesthanotherkindsofproperty;thereforetheirtheftrequiredastrongerdeterrentpenalty.

ItcertainlyshouldmoderateourreverenceforancestralwisdomtofindevenamanlikeFielding,thenovelist,speaking,inhisChargetotheGrandJuryofMiddlesex,ofthepilloryandthelossofaman’searsas‘anextremelymild’punishmentforabadcaseoflibel,ordeclaringourpunishmentsofthattimetobe‘themildestandmostvoidofterrorofanyotherintheknownworld.’YetFieldingrecognisedseveralofthetrueprinciplesofpunishment.Heattributedtheincreaseofcrimetothegreatabuseofpardons,which,hesaid,hadbroughtmanymorementothegallowsthantheyhadsavedfromit.Healsoadvocatedthediminutionofthenumberofexecutions,theirgreaterprivacyandsolemnity,whilstherecommendedtheirfollowingascloselyaspossibleonconviction,thatpityforthecriminalmightbelostindetestationforhiscrime.[33]

SixdaysafterhisarrivalBeccariawritesinasimilarstrain:thatheisinthemidstofadorationsandthemostflatteringpraises,consideredasthecompanionandcolleagueofthegreatestmeninEurope,regardedwithadmirationandcuriosity,hiscompanycompetedfor;inthecapitalofpleasures,closetothreetheatres,oneofthemtheComédieFran?aise,themostinterestingspectacleintheworld;andthatyetheisunhappyanddiscontented,andunabletofinddistractioninanything.Hetellshiswifethatheisinexcellenthealth,butthatshemustsayjustthecontrary,inorderthattheremaybeagoodpretextforhisreturn;andthebettertoensurethis,hesendshiswifeanotherletterwhichshemayshowtohisparents,andinwhich,attheendofmuchgeneralnewsaboutParis,healludesincidentallytothebadeffectonhishealthofdrinkingthewatersoftheSeine.Heregretshavingtoresorttothisfiction;butconsidersthatheisjustifiedbythecircumstances.
