Itisnottruethatthescienceshavealwaysbeeninjurioustomankind;whentheywereso,itwasaninevitableevil.Themultiplicationofthehumanraceoverthefaceoftheearthintroducedwar,theruderarts,andthefirstlaws,meretemporaryagreementswhichperishedwiththenecessitythatgaverisetothem.Thiswasmankind’sprimitivephilosophy,thefewelementsofwhichwerejust,becausetheindolenceandslightwisdomoftheirframerspreservedthemfromerror.Butwiththemultiplicationofmentherewenteveramultiplicationoftheirwants.Strongerandmorelastingimpressionswere,therefore,needed,inordertoturnthembackfromrepeatedlapsestothatprimitivestateofdisunionwhicheachreturntoitrenderedworse.Thoseprimitivedelusions,therefore,whichpeopledtheearthwithfalsedivinitiesandcreatedaninvisibleuniversethatgovernedourown,conferredagreatbenefit—Imeanagreatpoliticalbenefit—uponhumanity.Thosemenwerebenefactorsoftheirkind,whodaredtodeceivethemanddragthem,docileandignorant,toworshipatthealtars.Bypresentingtothemobjectsthatlaybeyondthescopeofsenseandfledfromtheirgraspthenearertheyseemedtoapproachthem—neverdespised,becauseneverwellunderstood—theyconcentratedtheirdividedpassionsuponasingleobject[247]ofsupremeinteresttothem.Thesewerethefirststepsofallthenationsthatformedthemselvesoutofsavagetribes;thiswastheepochwhenlargercommunitieswereformed,andsuchwastheirnecessaryandperhapstheironlybond.IsaynothingofthatchosenpeopleofGod,forwhomthemostextraordinarymiraclesandthemostsignalfavourswereasubstituteforhumanpolicy.Butasitisthequalityoferrortofallintoinfinitesubdivisions,sothesciencesthatgrewoutofitmadeofmankindablindfanaticalmultitude,which,shutupwithinacloselabyrinth,collidestogetherinsuchconfusion,thatsomesensitiveandphilosophicalmindshaveregrettedtothisdaytheancientsavagestate.Thatisthefirstepochinwhichthesciencesorratheropinionsareinjurious.

Nothingismoredangerousthanthatcommonaxiom,‘Wemustconsultthespiritofthelaws.’Itislikebreakingdownadambeforethetorrentofopinions.Thistruth,whichseemsaparadoxtoordinaryminds,morestruckastheyarebyalittlepresentinconveniencethanbytheperniciousbutremoteconsequenceswhichflowfromafalseprincipleenrootedamongapeople,seemstometobedemonstrated.Ourknowledgeandallourideasarereciprocallyconnectedtogether;andthemorecomplicatedtheyare,themorenumerousaretheapproachestothem,andthepointsofdeparture.Everymanhashisownpointofview—adifferentoneatdifferenttimes;sothat‘thespiritofthelaws’wouldmeantheresultofgoodorbadlogiconthepartofajudge,ofaneasyordifficultdigestion;itwoulddependnowontheviolenceofhispassions,nowonthe[128]feeblenessofthesufferer,ontherelationshipbetweenthejudgeandtheplaintiff,oronallthoseminuteforceswhichchangetheappearancesofeverythinginthefluctuatingmindofman.Henceitisthatweseeacitizen’sfatechangeseveraltimesinhispassagefromonecourttoanother;thatweseethelivesofwretchesatthemercyofthefalsereasoningsorofthetemporarycapriceofajudge,whotakesashisrightfulcanonofinterpretationthevagueresultofallthatconfusedseriesofnotionswhichaffecthismind.Henceitisthatweseethesamecrimespunisheddifferentlybythesamecourtatdifferenttimes,owingtoitshavingconsulted,nottheconstantandfixedvoiceofthelaws,buttheirunstableanderringinterpretations.TheEnd

Judgmentmustbenothingbuttheprecisetextofthelaw,andtheofficeofthejudgeisonlytopronouncewhethertheactioniscontraryorconformabletoit.

Evenifweassumethatdeathisabsolutelytheseverestpenaltydevisablebythelaw,andthatasapunishmentformurderitisnottoosevere,itremainscertain,that,relativelytothecircumstancesofatrial[40]formurder,tothereluctanceofjudgesorjuriestopassanirretrievablesentence,totheirfearoferror,totheirconscientiousregardforhumanlife,itisreallyamuchlessterribledangerforamalefactortofacethanapenaltywhichwouldjustifyfewerhopesofimpunity.
