Buttherewasanothersidetothebrightnessofthissuccess.Inliteratureasinwarnopositionofhonourcanbewonorheldwithoutdanger,andofthisBeccariaseemstohavebeenconsciouswhenhe[15]pleadedagainstthechargeofobscurity,thatinwritinghehadhadbeforehiseyesthefearofecclesiasticalpersecution.Hislovefortruth,heconfessed,stoppedshortattheriskofmartyrdom.Hehad,indeed,threeveryclearwarningstojustifyhisfears.Muratori,thehistorian,hadsufferedmuchfromaccusationsofheresyandatheism,andhadowedhisimmunityfromworseconsequenceschieflytotheliberalprotectionofPopeBenedictXIV.TheMarquisScipioMaffeihadalsoincurredsimilarchargesforhishistoricalhandlingofthesubjectofFree-will.Buttherewasevenastrongerwarningthanthese,andonenotlikelytobelostonamanwithyouthandlifebeforehim;thatwasthefateoftheunfortunateGiannone,who,onlysixteenyearsbeforeBeccariawrote,hadendedwithhislifeinthecitadelofTurinanimprisonmentthathadlastedtwentyyears,forcertainobservationsontheChurchofRomewhichhehadbeenrashenoughtoinsertinhis‘HistoryofNaples.’

Whatarethepretextsbywhichsecretaccusationsandpunishmentsarejustified?Aretheythepublicwelfare,thesecurityandmaintenanceoftheformofgovernment?Buthowstrangeaconstitutionisthat,wherehewhohasforceonhisside,andopinion,whichisevenstrongerthanforce,isafraidofeverycitizen!Isthentheindemnityoftheaccusertheexcuse?Inthatcasethelawsdonotsufficientlydefendhim;andshalltherebesubjectsstrongerthantheirsovereign?Orisittosavetheinformerfrominfamy?What!secretcalumnybefairandlawful,andanopenonedeservingofpunishment!Isit,then,thenatureofthecrime?Ifindifferentactions,orevenusefulactions,arecalledcrimes,thenofcourseaccusationsandtrialscanneverbesecretenough.Buthowcantherebecrimes,thatis,publicinjuries,unlessthepublicityofthisexample,byapublictrial,beatthesametime[144]theinterestofallmen?Irespecteverygovernment,andspeakofnoneinparticular.Circumstancesaresometimessuchthattoremoveanevilmayseemutterruinwhenitisinherentinanationalsystem.ButhadItodictatenewlawsinanyforgottencorneroftheuniverse,myhandwouldtrembleandallposteritywouldrisebeforemyeyesbeforeIwouldauthorisesuchacustomasthatofsecretaccusations.Inproportionaspunishmentsbecomemilder,clemencyandpardonbecomelessnecessary.Happythenationinwhichtheirexerciseshouldbebaneful!Clemency,therefore,thatvirtue,whichhassometimesmadeupinasovereignforfailingsinalltheotherdutiesofthethrone,oughttobeexcludedinaperfectsystemoflegislation,wherepunishmentsaremildandthemethodoftrialregularandexpeditious.Thistruthwillappearahardonetoanybodylivinginthepresentchaoticstateofthecriminallaw,wherethenecessityofpardonandfavoursaccordswiththeabsurdityofthelawsandwiththeseverityofsentencesofpunishment.Thisrightofpardonisindeedthefairestprerogativeofthethrone,themostdesirableattributeofsovereignty;itis,however,thetacitmarkofdisapprovalthatthebeneficentdispensersofthepublichappinessexhibittowardsacode,whichwithallitsimperfectionsclaimsinitsfavourtheprejudiceofages,thevoluminousandimposingarrayofinnumerablecommentators,theweightyapparatusofunendingformalities,andtheadhesionofthosepersonsofhalf-learningwho,thoughlessfearedthanrealphilosophers,arereallymoredangerous.Butletitberememberedthatclemencyisthevirtueof[191]themaker,notoftheexecutor,ofthelaws;thatitshouldbeconspicuousinthecodeoflawsratherthaninparticularjudgments;thattheshowingtomen,thatcrimesmaybepardonedandthatpunishmentisnottheirnecessaryconsequence,encouragesthehopeofimpunity,andcreatesthebeliefthatsentencesofcondemnation,whichmightberemittedandarenot,areratherviolentexhibitionsofforcethanemanationsofjustice.Whatshallbesaidthenwhenthesovereigngrantsapardon,thatis,publicimmunitytoanindividual,andwhenaprivateactofunenlightenedkindnessconstitutesapublicdecreeofimpunity?Letthelawsthereforebeinexorableandtheiradministratorsinparticularcasesinexorable,butletthelaw-makerbemild,merciful,andhumane.Lethimfoundhisedifice,asawisearchitect,onthebasisofself-love;letthegeneralinterestbethesumoftheinterestsofeach,andhewillnolongerbeconstrained,bypartiallawsandviolentremediestoseparateateverymomentthepublicwelfarefromthatofindividuals,andtoraisetheappearanceofpublicsecurityonfearandmistrust.Asaprofoundandfeelingphilosopherlethimallowmen,thatis,hisbrethren,toenjoyinpeacethatsmallshareofhappinesswhichisgiventhemtoenjoyinthiscorneroftheuniverse,inthatimmensesystemestablishedbytheFirstCause,byHimWhoIs.

Thecredibility,therefore,ofawitnessmustdiminishinproportiontothehatred,friendship,orcloseconnectionbetweenhimselfandtheaccused.Morethanonewitnessisnecessary,because,solongasoneaffirmsandanotherdenies,nothingisproved,andtherightwhicheveryonehasofbeingheldinnocentprevails.[140]Thecredibilityofawitnessbecomesappreciablyless,thegreatertheatrocityofthecrimeimputed,[66]ortheimprobabilityofthecircumstances,asinchargesofmagicandgratuitouslycruelactions.Itismorelikely,asregardstheformeraccusation,thatmanymenshouldliethanthatsuchanaccusationshouldbetrue,becauseitiseasierformanymentobeunitedinanignorantmistakeorinpersecutinghatredthanforonemantoexerciseapowerwhichGodeitherhasnotconferredorhastakenawayfromeverycreatedbeing.Thesamereasoningholdsgoodalsoofthesecondaccusation,formanisonlycruelinproportiontohisinteresttobeso,tohishatredor[141]tohisfear.Properlyspeaking,thereisnosuperfluousfeelinginhumannature,everyfeelingbeingalwaysinstrictaccordancewiththeimpressionsmadeuponthesenses.Inthesamewaythecredibilityofawitnessmaysometimesbelessenedbythefactofhisbeingamemberofsomesecretsociety,whosepurposesandprinciplesareeithernotwellunderstoodordifferfromthoseofgeneralacceptance;forsuchamanhasnotonlyhisownpassionsbutthoseofothersbesides.

Whatisthepoliticalobjectofpunishments?Theintimidationofothermen.Butwhatshallwesayofthesecretandprivatetortureswhichthetyrannyofcustomexercisesalikeupontheguiltyandtheinnocent?Itisimportant,indeed,thatnoopencrimeshallpassunpunished;butthepublicexposureofacriminalwhosecrimewashiddenindarknessisutterlyuseless.Anevilthathasbeendoneandcannotbeundonecanonlybepunishedbycivilsocietyinsofarasitmayaffectotherswiththehopeofimpunity.Ifitbetruethatthereareagreaternumberofmenwhoeitherfromfearorvirtuerespectthelawsthanofthosewhotransgressthem,theriskoftorturinganinnocentmanshouldbeestimatedaccordingtotheprobabilitythatanymanwillhavebeenmorelikely,otherthingsbeingequal,tohaverespectedthantohavedespisedthelaws.
