Injuriesthatarepersonalandaffectaman’shonour—thatis,thefairshareoffavourthathehasarighttoexpectfromothers—shouldbepunishedwithdisgrace.

Suchconsiderationsasthesewill,perhaps,leadsomedaytotheabolitionofcapitalpunishment.Thefinaltestofallpunishmentisitsefficiency,notitshumanity.Thereisoftenmoreinhumanityinalongsentenceofpenalservitudethaninacapitalsentence,forthemajorityofmurderersdeserveaslittlemercyastheyget.ThemanyoffenceswhichhaveceasedtobecapitalinEnglishlawyieldedlesstoasenseoftheinhumanityofthepunishmentasrelatedtothecrimethantotheexperiencethatsuchapunishmentledtoalmosttotalimpunity.Thebankers,forinstance,whopetitionedParliamenttoabolishcapitalpunishmentforforgery,didso,astheysaid,becausetheyfoundbyexperiencethattheinflictionofdeath,orthepossibilityofitsinfliction,preventedtheprosecution,theconviction,andthepunishmentofthecriminal;thereforetheybeggedfor‘thatprotectionfortheirpropertywhichtheywouldderivefromamorelenientlaw.’Thecloseconnection,therefore,ofcrimeandpunishmentisoftheutmostimportance,ifitbedesirablethatinroughandcommonmindsthereshould,togetherwiththeseductiveideaofanadvantageouscrime,immediatelystartuptheassociatedideaofitspunishment.Longdelayhasnoothereffectthantheperpetualseparationofthesetwoideas;andwhatevertheimpressionproducedbythepunishmentofacrime,itproducesitlessasapunishmentthanasasight,andonlyproducesitwhenthehorroroftheparticularcrime,whichwouldservetostrengthenthefeelingofthepunishment,hasbeenweakenedinthemindsofthespectators.

Itisunhappilynomeretheory,thatthemajorityofcrimesarecommittedpreciselybythosewhoriskmostincommittingthem;bythose,thatis,whocommitthemwiththeaggravatedpenaltyfullinview.Bytheexistinglaw(ofwhichboththeCriminalCode-andthePenalServitude-Commissionershaveproposedthemitigation)anyoneconvictedoffelonyafterapreviousconvictionforfelonyisliabletopenalservitudeforlife,ortoimprisonmentwithhardlabourforfouryears,withoneormorewhippings.Theminimumpunishmentforasecondconvictionoffelonyissevenyears.Yet,withtheknowledgeofsuchincreasedpunishmentsbeforetheireyes,withthefullconsciousnessoftheirliabilitiesasoldoffenders,officialstatisticsshowthatofboththemaleandfemaleconvictsintheEnglishconvictprisonsconsiderablymorethanhalfhaveincurredpreviousconvictions.[50]Ofthemaleconvictsin1878,79percent.,[93]andofthefemale89percent.,werecasesofreciduouscrime.Mayitnot,then,bearguedfromsuchafailureofthesystemtoanerrorintheprincipleonwhichitrests?Forisitnotevidentthattheaggravatedpenaltydoesaslittletodeterastheoriginalpunishmentdoestoreform?Therewasatimewhennearlyallpenaltieswerepecuniary.Men’scrimesweretheprince’spatrimony;attemptsagainstthepublicsafetywereanobjectofgain,andhewhosefunctionitwastodefenditfoundhisinterestinseeingitassailed.Theobjectofpunishmentwasthenasuitbetweenthetreasury,whichexactedthepenalty,andthecriminal:itwasacivilbusiness,aprivateratherthanapublicdispute,whichconferreduponthetreasuryotherrightsthanthoseconferreduponitbythecallsofthepublicdefence,whilstitinflictedupontheoffenderothergrievancesthanthosehehadincurredbythenecessityofexample.Thejudgewas,therefore,anadvocateforthetreasuryratherthananimpartialinvestigatorofthetruth,anagentfortheChancelloroftheExchequerratherthantheprotectorandministerofthelaws.Butasinthissystemtoconfessafaultwasthesamethingastoconfessoneselfadebtortothetreasury,thatbeingtheobjectofthecriminalprocedureinthosedays,sotheconfessionofacrime,andaconfessionsomanagedastofavourandnottohurtfiscalinterests,becameandstillremains(effectsalwaysoutlastingtheircausessolong)thecentre[241]pointofallcriminalprocedure.Withoutsuchconfessionacriminalconvictedbyindubitableproofswillincurapenaltylessthantheonelegallyattachedtohiscrime;andwithoutithewillescapetortureforothercrimesofthesamesortwhichhemayhavecommitted.Withit,ontheotherhand,thejudgebecomesmasterofacriminal’sperson,tolaceratehimbymethodandformality,inordertogetfromhimasfromsomuchstockalltheprofithecan.Giventhefactofthecrimeasproved,confessionaffordsaconvincingproof;and,tomakethisproofstilllessopentodoubt,itisforciblyexactedbytheagoniesanddespairofphysicalpain;whilstatthesametimeaconfessionthatisextra-judicial,thatistenderedcalmlyandindifferently,andwithouttheoverpoweringfearsofatrialbytorture,isheldinsufficientforaverdictofguilt.Inquiriesandproofs,whichthrowlightuponthefact,butwhichweakentheclaimsofthetreasury,areexcluded;norisitoutofconsiderationforhiswretchednessandweaknessthatacriminalissometimessparedfromtorture,butoutofregardfortheclaimswhichthisentity,nowmythicalandinconceivable,mightlose.Thejudgebecomestheenemyoftheaccused,whostandsinchainsbeforehim,thepreyofmisery,oftorments,andthemostterriblefuture;hedoesnotseektofindthetruthofafact,buttofindthecrimeintheprisoner,tryingtoentraphim,andthinkingittothelossofhisown[242]creditifhefailtodoso,andtothedetrimentofthatinfallibilitywhichmenpretendtopossessabouteverything.Theevidencethatjustifiesaman’simprisonmentrestswiththejudge;inorderthatamanmayprovehimselfinnocent,hemustfirstbedeclaredguilty:thatiscalledanoffensiveprosecution;andsucharecriminalproceedingsinnearlyeverypartofenlightenedEurope,intheeighteenthcentury.Therealprosecution,theinformativeone—thatis,theindifferentinquiryintoafact,suchasreasonenjoins,suchasmilitarycodesemploy,andsuchasisusedevenbyAsiaticdespotismintrivialandunimportantcases—isofveryscantuseinthetribunalsofEurope.Whatacomplexmazeofstrangeabsurdities,doubtlessincredibletoamorefortunateposterity!Onlythephilosophersofthattimewillreadinthenatureofmanthepossibleactualityofsuchasystemasnowexists.

Bythesamerule,inthecaseoftheft,thevalueofthethingstolen,withsomeequivalentforthetroubleofitsrecovery,takenfromtheoffenderormadealienonhisearnings,appearstobeallthatjusticecandemand.SirSamuelRomilly,himselfsecondtononeasalawyer,wroteseventyyearsago:‘Iftherestitutionofthepropertystolen,andonlyafewweeks’orevenbutafewdays’imprisonmentweretheunavoidableconsequenceoftheft,notheftwouldeverbecommitted.’Yetthefollowingsentencesaretaken[85]atrandomfromauthenticEnglishsources:threemonths’imprisonmentforstealingapipe,sixmonthsforstealingapenny,atwelvemonthforstealinganumbrella,fiveyears’penalservitudeforstealingsomestampsfromaletter,sevenyearsforstealingtwopence.Insuchcasestheprincipleofvindictivenessexceedsthelimitsofnecessity,andthereforeofjustice;whilstthelawlosesallitsdignityastheexpressionofunimpassionedresentment.

Anyactionthatisnotincludedbetweenthetwoabove-indicatedextremescanonlybecalledacrimeorpunishedassuchbythosewhofindtheirinterestinsocallingit.Theuncertaintyoftheselimitshasproducedindifferentnationsasystemofethicscontrarytothesystemoflaws,hasproducedmanyactualsystemsoflawsattotalvariancewithoneanother,andaquantityoflawswhichexposeeventhewisestmantotheseverestpenalties.Consequentlythewordsvirtueandvicehavebecomeofvagueandvariablemeaning,andfromtheuncertaintythussurroundingindividualexistence,listlessnessandafatalapathyhavespreadoverpoliticalcommunities.

Again,Proportionbetweencrimeandpunishmentseemstobeanothernaturaldemandofequity.Yetitisevidentthatitisonlyapproximatelypossible,andwillvaryineveryageandcountryaccordingtotheprevalentnotionsofmorality.Isimprisonmentforayear,orimprisonmentforlife,orforhowlong,afairandproportionatepunishmentforperjury?Whoshalldecide?Shallwesubmitittotheopinionofthejudges?ButhasnotRomillyleftonrecordthestoryofthetwomentriedbytwodifferentjudgesforstealingsomechickens,whoweresentencedrespectivelyonetoimprisonmentfortwomonths,andtheothertotransportation?Shallwethengiveupallattemptatproportionandapplythesamedeterrentasequallyefficaciousagainstslightorgraveoffences?Draco,whenaskedwhyhemadedeaththepunishmentformostoffencesthatwerepossible,issaidtohavereplied,‘Smallonesdeserveit,andIcanfindnogreaterforthegravest.’Thesamereasoningwasforalongtimethatofourownlaw;andinJapan,[78]whereeverywrongactwasoneofdisobediencetotheEmperor,andaccordinglyofequalvalue,thesamepenaltyofdeathforgambling,theft,ormurder,obviatedalldifficultieswithregardtoaproportionwhichiseasiertoimaginethanitistodefine.

Thereisalsoafourthconsequenceoftheaboveprinciples:thattherighttointerpretpenallawscannotpossiblyrestwiththecriminaljudges,forthe[126]veryreasonthattheyarenotlegislators.Thejudgeshavenotreceivedthelawsfromourancestorsasafamilytradition,asalegacythatonlylefttoposteritythedutyofobeyingthem,buttheyreceivethemfromlivingsociety,orfromthesovereignthatrepresentsitandisthelawfultrusteeoftheactualresultofmen’scollectivewills;theyreceivethem,notasobligationsarisingfromanancientoath[65](null,becauseitboundwillsnottheninexistence,andiniquitous,becauseitreducedmenfromastateofsocietytothatofaflock),butastheresultofthetacitorexpressedoathmadetothesovereignbytheunitedwillsoflivingsubjects,aschainsnecessaryforcurbingandregulatingthedisorderscausedbyprivateinterests.Thisisthenaturalandrealsourceoftheauthorityofthelaws.
