Theresult,then,oftortureisamatteroftemperament,ofcalculation,whichvarieswitheachmanaccording[152]tohisstrengthandsensibility;sothatbythismethodamathematicianmightsolvebetterthanajudgethisproblem:‘Giventhemuscularforceandthenervoussensibilityofaninnocentman,tofindthedegreeofpainwhichwillcausehimtopleadguiltytoagivencrime.’

Thereare,however,certainlimitationseventothesupposeduniversalityofthecustom.FortheRomanjuristsdidnotconsiderare-convictionasacircumstanceinitselfwhichjustifiedaggravationofpunishment;andallthatcanbegatheredfromsomefragmentsinthePandectsandCodeis,thatsomeparticularcasesofrepeatedcrimeswerepunishedmoreseverelythanafirstoffence.Buttheywerecrimesofthesamekind;andamanwhosefirstcrime[91]wasatheftandwhosesecondwasanassaultwouldnothaveincurredanaggravatedpenalty.Itisthesameto-dayintheAustrian,Tuscan,andafewothercodes:asecondcrimeisonlypunishedmoreseverelyasasecondcrimewhenitisofthesamekindasthefirst,sothatitwouldnotsufficetoprovesimplyapreviousconvictionforfelonyirrespectiveoftheparticularsort.Thereisalsoanotherlimitationthathassometimesbeenrecognised,forintheRomanlawtheruleofanincreasedpenaltyfelltotheground,ifthreeyearselapsedwithoutoffencebetweenthepunishmentforonecrimeandthecommissionofasecond.[49]

Thisuselessprodigalityofpunishments,bywhichmenhaveneverbeenmadeanybetter,hasdrivenmetoexaminewhetherthepunishmentofdeathbereallyusefulandjustinawellorganisedgovernment.Whatkindofrightcanthatbewhichmenclaimfortheslaughteroftheirfellow-beings?Certainlynotthatrightwhichisthesourceofsovereigntyandoflaws.Forthesearenothingbutthesum-totalofthesmallestportionsofindividualliberty,andrepresentthegeneralwill,thatis,theaggregateofindividualwills.Butwhoeverwishedtoleavetoothermentheoptionofkillinghim?Howintheleastpossiblesacrificeofeachman’slibertycantherebeasacrificeofthegreatestofallgoods,namely,oflife?Andiftherecouldbethatsacrifice,howwouldsuchaprincipleaccordwiththeother,thatamanisnotthe[170]masterofhisownlife?Yethemusthavebeenso,couldhehavegiventohimselfortosocietyasabodythisrightofkillinghim.

Thegreatesteffectthatanypunishmenthasuponthehumanmindisnottobemeasuredbyitsintensitybutbyitsduration,foroursensibilityismoreeasilyandpermanentlyaffectedbyveryslightbutrepeatedimpressionsthanbyastrongbutbriefshock.Habitholdsuniversalswayovereverysentientbeing,andaswespeakandwalkandsatisfyourneedsbyitsaid,somoralideasonlystampthemselvesonourmindbylongandrepeatedimpressions.Itisnottheterribleyetbriefsightofacriminal’sdeath,butthelongandpainfulexampleofamandeprivedof[172]hisliberty,who,havingbecomeasitwereabeastofburthen,repayswithhistoilthesocietyhehasoffended,whichisthestrongestrestraintfromcrimes.Farmorepotentthanthefearofdeath,whichmeneverhavebeforetheireyesintheremotedistance,isthethought,soefficaciousfromitsconstantrecurrence:‘ImyselfshallbereducedtoaslongandmiserableaconditionifIcommitsimilarmisdeeds.’

CHAPTERXV.THEMILDNESSOFPUNISHMENTS.

BythepresentEnglishlawapersonconvictedofmoreoffencesthanonemaybesentencedforeachoffenceseparately,thepunishmentofeachonein[106]successiontakingeffectontheexpirationoftheother.Bythislaw(whichtheCriminalCodeCommissionersproposetoalter)imprisonmentmaybespreadoverthewholeofalifetime.OnthispointtheChineselawagainoffersamodel,foritenactsthatwhentwoormoreoffencesareprovedagainstaman,theyshallallbeestimatedtogether,andthepunishmentofallthelesseroffencesbeincludedinthatoftheprincipalcharge,notinadditiontoitSoalsoiftheoffencesarechargedatdifferenttimes,andthepunishmentofonehasbeenalreadydischarged,thereisnofurtherpunishmentfortheothersubsequentcharges,unlesstheybechargesofgreatercriminality,inwhichcaseonlythedifferencebetweenthepunishmentscanbelegallyincurred.[63]Butthisofcoursepresupposesadefinitescaleofcrimesandpunishments.
