But,inspiteoftheliberalismoftheCount,thepenallawsandcustomsofLombardyremainedthesame;andthecruellegalprocedurebytortureexistedstill,untouchedbythesalutaryreformseffectedinotherdepartmentsoftheGovernment.Therewasthepreparatorytorture,toextortconfessionfromcriminalsnotyetcondemned;therewastortureforthediscoveryofacriminal’saccomplices;andtherewastheextraordinaryorgreatertorture,whichprecededtheexecutionofasentenceofdeath.Itistruethattorturecouldonlybeappliedtocrimesofacapitalnature,buttherewasscarcelyanactinthepossiblecategoryofcrimesthatwasnotthenpunishablewithdeath.Proofsofguiltweresoughtalmostentirelyfromtortureandsecretaccusations,whilstpenaltiesdependedlessonthetextofanyknownlawthanonthediscretion—thatis,onthecaprice—ofthemagistrate.

Thedeathofacitizencanonlybedeemednecessaryfortworeasons.Thefirstiswhen,thoughdeprivedofhispersonalfreedom,hehasstillsuchconnectionsandpowerasthreatenthenationalsecurity;whenhisexistenceiscapableofproducingadangerousrevolutionintheestablishedformofgovernment.Thedeathofacitizenbecomesthennecessarywhenthenationisrecoveringorlosingitsliberty,orinatimeofanarchy,whenconfusiontakestheplaceoflaws;butintimeswhenthelawsholdundisturbedsway,whentheformofgovernmentcorrespondswiththewishesofaunitednation,andisdefendedinternallyandexternallybyforce,andbyopinionwhichisperhapsevenstrongerthanforce,wherethesupremepowerrestsonlywiththerealsovereign,andrichesservetopurchasepleasuresbutnotplaces,Iseenonecessityfordestroyingacitizen,exceptwhenhisdeathmightbetherealandonlyrestraintfordivertingothersfromcommittingcrimes;thislatter[171]caseconstitutingthesecondreasonforwhichonemaybelievecapitalpunishmenttobebothjustandnecessary.

CHAPTERXLII.CONCLUSION.
