Capitalpunishmentisinjuriousbytheexampleofbarbarityitpresents.Ifhumanpassions,orthenecessitiesofwar,havetaughtmentoshedoneanother’sblood,thelaws,whichareintendedtomoderatehumanconduct,oughtnottoextendthesavageexample,whichinthecaseofalegalexecutionisallthemorebanefulinthatitiscarriedoutwithstudiedformalities.Tomeitseemsanabsurdity,thatthelaws,whicharetheexpressionofthepublicwill,whichabhorandwhichpunishmurder,shouldthemselves[177]commitone;andthat,todetercitizensfromprivateassassination,theyshouldthemselvesorderapublicmurder.Whatarethetrueandthemostusefullaws?Aretheynotthosecovenantsandconditionswhichallwouldwishobservedandproposed,whentheincessantvoiceofprivateinterestishushedorisunitedwiththeinterestofthepublic?Whatareeveryman’sfeelingsaboutcapitalpunishment?Letusreadtheminthegesturesofindignationandscornwithwhicheveryonelooksupontheexecutioner,whois,afterall,aninnocentadministratorofthepublicwill,agoodcitizencontributorytothepublicwelfare,aninstrumentasnecessaryfortheinternalsecurityofaStateasbravesoldiersareforitsexternal.What,then,isthesourceofthiscontradiction;andwhyisthisfeeling,inspiteofreason,ineradicableinmankind?Becausemenintheirmostsecrethearts,thatpartofthemwhichmorethananyotherstillpreservestheoriginalformoftheirfirstnature,haveeverbelievedthattheirliveslieatnoone’sdisposal,saveinthatofnecessityalone,which,withitsironsceptre,rulestheuniverse.

Thereareafewobviousremediesbywhichtheinducementstocrimemightbeeasilydiminished.In1808SirSamuelRomillybroughtinabill,toprovidepersonstriedandacquittedoffelonywithcompensation,atthediscretionofthejudge,forthelosstheyincurredbytheirdetentionandtrial.Thiswasobjectedto,onthegroundthatthepaymentofsuchcompensationoutofthecountyrateswoulddiscourageprosecutions;andtheonlyjusticedonetomenfalselyaccusedfromthatdaytothisistheauthorisationgiventogoal-governorsin1878toprovideprisoners,whohavebeenbroughtfromanothercountyfortrialattheassizesandhavebeenacquitted,withmeansofreturningtotheirownhomes.Somethingmorethanthisisrequiredtosaveamansosituatedfromfallingintorealcrime.

Thefirstclassofcrimes—thatis,theworst,becausetheyarethemostinjurioustosociety—arethoseknownascrimesofhightreason.Onlytyrannyandignorance,whichconfoundwordsandideasoftheclearestmeaning,canapplythisname,andconsequentlytheheaviestpunishment,todifferentkindsofcrimes,thusrenderingmen,asinathousandothercases,thevictimsofaword.Everycrime,beiteversoprivate,injuressociety;buteverycrimedoesnotaimatitsimmediatedestruction.Moral,likephysicalactions,havetheirlimitedsphereofactivity,andaredifferentlycircumscribed,likeallthemovementsofnature,bytimeandspace;andthereforeonlyasophisticalinterpretation,whichisgenerallythephilosophyofslavery,canconfoundwhateternaltruthhasdistinguishedbyimmutabledifferences.
