Thereseemtobethreeprincipalreasonswhy,underourpresentsystem,crimestillkeepsitsgenerallevel,irrespectiveofallchangesinourdegreesofpunishment.CHAPTERI.BECCARIA’SLIFEANDCHARACTER.

Theveryseverityofapunishmentleadsmentodaresomuchthemoretoescapeit,accordingtothegreatnessoftheevilinprospect;andmanycrimesarethuscommittedtoavoidthepenaltyofasingleone.Countriesandtimeswherepunishmentshavebeenmostseverehaveeverbeenthosewherethebloodiestandmostinhumandeedshavebeencommitted,thesamespiritofferocitythatguidedthehandofthelegislatorhavingguidedalsothatoftheparricideandassassin;onthethronedictatingiron[168]lawsforthevillanoussoulsofslavestoobey,andintheobscurityofprivatelifeurgingtotheslaughteroftyrants,onlytocreatefreshonesintheirstead.

TheChinesepenalcodeof1647isprobablythenearestapproachtoBeccaria’sconception,andnothingismoremarvellousthantheprecisionwithwhichitapportionspunishmentstoeveryshadeofcrime,leavingnoconceivableoffence,ofcommissionor[86]omission,withoutitsexactnumberofbamboostrokes,itsexactpecuniarypenalty,oritsexacttermordistanceofbanishment.Itisimpossibleinthiscodetoconceiveanydiscretionorroomfordoubtlefttothejudicialofficersbeyondthediscoveryofthefactofanallegedcrime.Butwhatispracticableinonecountryispracticableinanother;sothatthechargesooftenurgedagainstthuseliminatingjudicialdiscretion,thatitisfairintheorybutimpossibleinpractice,findsitselfatdirectissuewiththefactsofactuallife.

Finally,amanwho,whenexamined,persistsinanobstinaterefusaltoanswer,deservesapunishment[146]fixedbythelaws,andoneoftheheaviesttheycaninflict,thatmenmaynotinthiswayescapethenecessaryexampletheyowetothepublic.Butthispunishmentisnotnecessarywhenitisbeyondalldoubtthatsuchapersonhascommittedsuchacrime,questionsbeinguseless,inthesamewaythatconfessionis,whenotherproofssufficientlydemonstrateguiltAndthislastcaseisthemostusual,forexperienceprovesthatinthemajorityoftrialstheaccusedarewonttoplead‘Notguilty.’ThefirsttraceofBeccaria’sinfluenceinEnglandappearedinthefirsteditionofBlackstone’sCommentaries,ofwhichthebookontheCriminalLaws[48]waspublishedtheverynextyearaftertheappearanceoftheItaliantreatise.ThatBlackstonewaswellacquaintedwithitisprovedbyhisfrequentreferencetoitintreatingofcrimes.FromBeccariahearguesthatthecertaintyofpunishmentsismoreeffectualthantheirseverity,andfindsitabsurdtoapplythesamepunishmenttocrimesofdifferentmalignity.BlackstonewasalsothefirstprofessionallawyertofindfaultwiththefrequencyofcapitalpunishmentinEngland,andtopointoutas‘amelancholytruth’thepresenceof160actionsinthestatutebookwhichwerefelonieswithoutbenefitofclergy.

ItcertainlyshouldmoderateourreverenceforancestralwisdomtofindevenamanlikeFielding,thenovelist,speaking,inhisChargetotheGrandJuryofMiddlesex,ofthepilloryandthelossofaman’searsas‘anextremelymild’punishmentforabadcaseoflibel,ordeclaringourpunishmentsofthattimetobe‘themildestandmostvoidofterrorofanyotherintheknownworld.’YetFieldingrecognisedseveralofthetrueprinciplesofpunishment.Heattributedtheincreaseofcrimetothegreatabuseofpardons,which,hesaid,hadbroughtmanymorementothegallowsthantheyhadsavedfromit.Healsoadvocatedthediminutionofthenumberofexecutions,theirgreaterprivacyandsolemnity,whilstherecommendedtheirfollowingascloselyaspossibleonconviction,thatpityforthecriminalmightbelostindetestationforhiscrime.[33]

Inorderthatapunishmentmaybejust,itmustcontainonlysuchdegreesofintensityassufficetodetermenfromcrimes.Butasthereisnoonewhoonreflectionwouldchoosethetotalandperpetuallossofhisliberty,howevergreattheadvantagesofferedhimbyacrime,theintensityofthepunishmentofservitudeforlife,substitutedforcapitalpunishment,hasthatinitwhichissufficienttodauntthemostdeterminedcourage.Iwilladdthatitisevenmoredeterrentthandeath.Verymanymenfacedeathcalmlyandfirmly,somefromfanaticism,somefromvanity,whichalmostalwaysattendsamantothetomb;othersfromalastdesperateattempteithernolongertoliveortoescapefromtheirmisery;butneitherfanaticismnorvanityhaveanyplaceamongfettersandchains,underthestick,undertheyoke,inacageofiron;thewretchthuspunishedissofarfromterminatinghismiseriesthatwithhispunishmentheonlybeginsthem.
