“彩 票 在 线 网 页”NothingcouldbemoreinterestingthanLordKames’accountofthegrowthofcriminallaw,fromtheruderevengesofsavagestothelegalpunishmentsofcivilisedStates;butitwasprobablyintendedbyitsauthorlessasanhistoricaltreatisethanasaveiledattackuponthepenalsystemofhiscountry.Itis,therefore,agoodillustrationofthetimidityoftheTheoreticalschoolagainsttheoverwhelmingforcesofthePracticalschooloflaw,which,ofcourse,included[51]thegreatbodyofthelegalprofession;anditisthefirstsignofanattempttoapplytheexperienceofothercountriesandtimestotheimprovementofourownjurisprudence.Itisbettertopreventcrimesthantopunishthem.Thisisthechiefaimofeverygoodsystemoflegislation,whichistheartofleadingmentothegreatestpossiblehappinessortotheleastpossiblemisery,[243]accordingtocalculationofallthegoodsandevilsoflife.Butthemeanshithertoemployedforthisendareforthemostpartfalseandcontrarytotheendproposed.Itisimpossibletoreducetheturbulentactivityofmentoageometricalharmonywithoutanyirregularityorconfusion.Astheconstantandmostsimplelawsofnaturedonotpreventaberrationsinthemovementsoftheplanets,so,intheinfiniteandcontradictoryattractionsofpleasureandpain,disturbancesanddisordercannotbepreventedbyhumanlaws.Yetthisisthechimerathatnarrow-mindedmenpursue,whentheyhavepowerintheirhands.Toprohibitanumberofindifferentactsisnottopreventthecrimesthatmayarisefromthem,butitistocreatenewonesfromthem;itistogivecapriciousdefinitionsofvirtueandvicewhichareproclaimedaseternalandimmutableintheirnature.Towhatshouldwebereducedifeverythinghadtobeforbiddenuswhichmighttemptustoacrime?Itwouldbenecessarytodepriveamanoftheuseofhissenses.Foronemotivethatdrivesmentocommitarealcrimethereareathousandthatdrivethemtothecommissionofthoseindifferentactswhicharecalledcrimesbybadlaws;andifthelikelihoodofcrimesisproportionedtothenumberofmotivestocommitthem,anincreaseofthefieldofcrimesisanincreaseofthelikelihoodoftheircommission.Themajorityoflawsarenothingbut[244]privileges,oratributepaidbyalltotheconvenienceofsomefew.

Wehaveseenthatthetruemeasureofcrimesistheinjurydonetosociety.Thisisoneofthosepalpabletruthswhich,howeverlittledependentonquadrantsortelescopesfortheirdiscovery,andfullywithinthereachofanyordinaryintelligence,areyet,byamarvellouscombinationofcircumstances,onlyrecognisedclearlyandfirmlybysomefewthinkers,belongingtoeverynationalityandtoeveryage.ButAsiaticideas,andpassionsclothedwithauthorityandpower,have,generallybyimperceptiblemovements,sometimesbyviolentassaultsonthetimidcredulityofmankind,dissipatedthosesimplenotions,whichperhapsformedthefirstphilosophyofprimitivecommunities,andtowhichtheenlightenmentofthisageseemslikelytoreconductus,buttodosowiththatgreatersureness,whichcanbegainedfromanexact[200]investigationintothings,fromathousandunhappyexperiences,andfromtheveryobstaclesthatmilitateagainstit.

CHAPTERXIX.THEPROMPTNESSOFPUNISHMENTS.

Thereare,however,certainlimitationseventothesupposeduniversalityofthecustom.FortheRomanjuristsdidnotconsiderare-convictionasacircumstanceinitselfwhichjustifiedaggravationofpunishment;andallthatcanbegatheredfromsomefragmentsinthePandectsandCodeis,thatsomeparticularcasesofrepeatedcrimeswerepunishedmoreseverelythanafirstoffence.Buttheywerecrimesofthesamekind;andamanwhosefirstcrime[91]wasatheftandwhosesecondwasanassaultwouldnothaveincurredanaggravatedpenalty.Itisthesameto-dayintheAustrian,Tuscan,andafewothercodes:asecondcrimeisonlypunishedmoreseverelyasasecondcrimewhenitisofthesamekindasthefirst,sothatitwouldnotsufficetoprovesimplyapreviousconvictionforfelonyirrespectiveoftheparticularsort.Thereisalsoanotherlimitationthathassometimesbeenrecognised,forintheRomanlawtheruleofanincreasedpenaltyfelltotheground,ifthreeyearselapsedwithoutoffencebetweenthepunishmentforonecrimeandthecommissionofasecond.[49]Thesecondpretextfortortureisitsapplicationtosupposedcriminalswhocontradictthemselvesunderexamination,asifthefearofthepunishment,theuncertaintyofthesentence,thelegalpageantry,themajestyofthejudge,thestateofignorancethatiscommonaliketoinnocentandguilty,werenotenoughtoplungeintoself-contradictionboththeinnocentman[154]whoisafraid,andtheguiltymanwhoseekstoshieldhimself;asifcontradictions,commonenoughwhenmenareattheirease,werenotlikelytobemultiplied,whenthemindisperturbedandwhollyabsorbedinthethoughtofseekingsafetyfromimminentperil.

Isaidthatthepromptnessofpunishmentismoreuseful,becausetheshortertheintervaloftimebetweenthepunishmentandthemisdeed,thestrongerandthemorelastinginthehumanmindistheassociationoftheseideas,crimeandpunishment,sothatinsensiblytheycometobeconsidered,theoneasthecauseandtheotherasitsnecessaryandinevitableconsequence.Itisaprovedfactthattheassociationofideasisthecementofthewholefabricofthehumanintellect,andthatwithoutitpleasureandpainwouldbeisolatedandineffectivefeelings.Thefurtherremovedmenarefromgeneralideasanduniversalprinciples,thatis,themorecommonplacetheyare,themoretheyactbytheirimmediateandnearestassociations,totheneglectofremoterandmorecomplexones,thelatterbeingofserviceonly[187]tomenstronglyimpassionedforagivenobjectofpursuit,inasmuchasthelightofattentionilluminatesasingleobject,whilstitleavestheothersobscure.Theyarealsoofservicetomindsofahigherquality,because,havingacquiredthehabitofrunningrapidlyovermanysubjectsatatime,theypossessfacilityinplacingincontrastwithoneanothermanypartialfeelings,sothattheresultoftheirthoughts,inotherwords,theiraction,islessperilousanduncertain.

Theobject,therefore,ofthischapterischiefly[70]negative,beingnoneotherthantoraisesuchmistrustofmerecustom,andsostrongasenseofdoubt,bythecontradictionsapparentinexistinglawsandtheories,thatthedifficultiesoftheirsolutionmaytempttosomeinvestigationoftheprinciplesonwhichtheyrest.
