Wouldyoupreventcrimes,thenseethatenlightenmentaccompaniesliberty.Theevilsthatflowfromknowledgeareininverseratiotoitsdiffusion;thebenefitsdirectlyproportionedtoit.Aboldimpostor,whoisneveracommonplaceman,isadoredbyanignorantpeople,despisedbyanenlightenedone.Knowledge,byfacilitatingcomparisonsbetweenobjectsandmultiplyingmen’spointsofview,bringsmanydifferentnotionsintocontrast,causingthemtomodifyoneanother,allthemoreeasilyasthesameviewsandthesamedifficultiesareobservedinothers.Inthefaceofawidelydiffusednationalenlightenmentthecalumniesofignorancearesilent,andauthority,disarmedofpretextsforitsmanifestation,trembles;whilsttherigorousforceofthelawsremainsunshaken,nooneofeducationhavinganydisliketotheclearandusefulpubliccompactswhichsecurethecommonsafety,whenhecomparesthetriflinganduselesslibertysacrificedbyhimselfwiththesum-totalofallthelibertiessacrificedbyothers,whowithoutthelawsmighthavebeenhostiletohimself.Whoeverhasasensitivesoul,whenhecontemplatesacodeofwell-madelaws,andfindsthathehasonlylosttheperniciouslibertyofinjuringothers,willfeel[246]himselfconstrainedtoblessthethroneandthemonarchthatsitsuponit.

CHAPTERXXXII.OFDEBTORS.

Thereareafewobviousremediesbywhichtheinducementstocrimemightbeeasilydiminished.In1808SirSamuelRomillybroughtinabill,toprovidepersonstriedandacquittedoffelonywithcompensation,atthediscretionofthejudge,forthelosstheyincurredbytheirdetentionandtrial.Thiswasobjectedto,onthegroundthatthepaymentofsuchcompensationoutofthecountyrateswoulddiscourageprosecutions;andtheonlyjusticedonetomenfalselyaccusedfromthatdaytothisistheauthorisationgiventogoal-governorsin1878toprovideprisoners,whohavebeenbroughtfromanothercountyfortrialattheassizesandhavebeenacquitted,withmeansofreturningtotheirownhomes.Somethingmorethanthisisrequiredtosaveamansosituatedfromfallingintorealcrime.

Tortureisacertainmethodfortheacquittalofrobustvillainsandforthecondemnationofinnocentbutfeeblemen.Seethefataldrawbacksofthispretendedtestoftruth—atest,indeed,thatisworthyofcannibals;atestwhichtheRomans,barbarousastheytoowereinmanyrespects,reservedforslavesalone,thevictimsoftheirfierceandtoohighlylaudedvirtue.Oftwomen,equallyinnocentorequallyguilty,therobustandcourageouswillbeacquitted,theweakandthetimidwillbecondemned,byvirtueofthefollowingexacttrainofreasoningonthepartofthejudge:‘Iasjudgehadtofindyouguiltyofsuchandsuchacrime;you,AB,havebyyourphysicalstrengthbeenabletoresistpain,andthereforeIacquityou;you,CD,inyourweaknesshaveyieldedtoit;thereforeIcondemnyou.Ifeelthataconfessionextortedamidtormentscanhavenoforce,butIwilltortureyouafreshunlessyoucorroboratewhatyouhavenowconfessed.’

Themajorityofmankindlackthatvigourwhichisequallynecessaryforthegreatestcrimesasforthegreatestvirtues;whenceitwouldappear,thatbothextremesarecontemporaneousphenomenainnations[162]whichdependratherontheenergyoftheirgovernmentandofthepassionsthattendtothepublicgood,thanontheirsizeandtheconstantgoodnessoftheirlaws.Inthelattertheweakenedpassionsseemmoreadaptedtomaintainthantoimprovetheformofgovernment.Fromwhichflowsanimportantconsequence,namely,thatgreatcrimesinanationdonotalwaysproveitsdecline.

ItcertainlyshouldmoderateourreverenceforancestralwisdomtofindevenamanlikeFielding,thenovelist,speaking,inhisChargetotheGrandJuryofMiddlesex,ofthepilloryandthelossofaman’searsas‘anextremelymild’punishmentforabadcaseoflibel,ordeclaringourpunishmentsofthattimetobe‘themildestandmostvoidofterrorofanyotherintheknownworld.’YetFieldingrecognisedseveralofthetrueprinciplesofpunishment.Heattributedtheincreaseofcrimetothegreatabuseofpardons,which,hesaid,hadbroughtmanymorementothegallowsthantheyhadsavedfromit.Healsoadvocatedthediminutionofthenumberofexecutions,theirgreaterprivacyandsolemnity,whilstherecommendedtheirfollowingascloselyaspossibleonconviction,thatpityforthecriminalmightbelostindetestationforhiscrime.[33]Thereisageneraltheoremwhichismostusefulforcalculatingthecertaintyofafact,as,forinstance,theforceoftheproofsinthecaseofagivencrime:

Themorespeedilyandthemorenearlyinconnectionwiththecrimecommittedpunishmentshallfollow,themorejustandusefulitwillbe.Isaymorejust,becauseacriminalistherebysparedthoseuselessandfiercetormentsofsuspensewhichareallthegreaterinapersonofvigorousimaginationandfullyconsciousofhisownweakness;morejustalso,becausetheprivationofliberty,initselfapunishment,canonlyprecedethesentencebytheshortestpossibleintervalcompatiblewiththerequirementsofnecessity.Imprisonment,therefore,issimplythesafecustodyofacitizenpendingtheverdictofhisguilt;andthiscustody,beingessentiallydisagreeable,oughttobeasbriefandeasyaspossible.Theshortnessofthetimeshouldbemeasuredbothbythenecessarylengthofthepreparationsforthetrialandbytheseniorityofclaimtoajudgment.Thestrictnessofconfinementshouldbenomorethanisnecessaryeitherforthepreventionofescapeorforguardingagainsttheconcealmentoftheproofofcrimes.Thetrialitselfshouldbefinishedintheshortesttimepossible.Whatcontrast[186]morecruelthanthatbetweenajudge’seaseandadefendant’sanguish?betweenthecomfortsandpleasuresofanunfeelingmagistrateontheonehand,andthetearsandwretchednessofaprisonerontheother?Ingeneral,theweightofapunishmentandtheconsequenceofacrimeshouldbeasefficaciousaspossiblefortherestraintofothermenandaslittlehardaspossiblefortheindividualwhoispunished;foronecannotcallthataproperformofsociety,whereitisnotaninfallibleprinciple,thatitsmembersintended,inconstitutingit,tosubjectthemselvestoasfewevilsaspossible.
