Somepersonshavemaintainedthatacrime,thatis,anactioncontrarytothelaws,ispunishablewherevercommitted,asifthecharacterofsubject[193]wereindelible,or,inotherwords,synonymouswith,nay,worsethan,thecharacterofslave;asifamancouldbethesubjectofonekingdomandtheresidentofanother,orasifhisactionscouldwithoutcontradictionbesubordinatetotwosovereignpowersandtotwolegalsystemsoftencontradictory.Sosomethinkthatacruelactiondone,say,atConstantinopleispunishableatParis,fortheabstractreasonthathewhooffendshumanitydeservestohavecollectivehumanityforhisenemy,andmeritsuniversalexecration;asifjudgesweretheavengersofhumansensibilityingeneral,andnotratherofthecovenantsthatbindmentogether.Theplaceofpunishmentistheplaceofthecrime,becausethere,andthereonly,isitacompulsorydutytoinjureanindividual,topreventaninjurytothepublic.Avillain,butonewhohasnotbrokenthecovenantsofthesocietyofwhichhewasnotamember,maybeanobjectoffear,andforthatreasonbeexpelledandexiledbythesuperiorpowerofthatsociety;buthecannotbelegallyandformallypunished,sinceitisforthelawstoavenge,nottheintrinsicmaliceofparticularactions,buttheviolationofcompacts.

Themajorityofmankindlackthatvigourwhichisequallynecessaryforthegreatestcrimesasforthegreatestvirtues;whenceitwouldappear,thatbothextremesarecontemporaneousphenomenainnations[162]whichdependratherontheenergyoftheirgovernmentandofthepassionsthattendtothepublicgood,thanontheirsizeandtheconstantgoodnessoftheirlaws.Inthelattertheweakenedpassionsseemmoreadaptedtomaintainthantoimprovetheformofgovernment.Fromwhichflowsanimportantconsequence,namely,thatgreatcrimesinanationdonotalwaysproveitsdecline.Asit,then,wasnecessitywhichconstrainedmentoyieldapartoftheirindividualliberty,itiscertainthateachwouldonlyplaceinthegeneraldeposittheleastpossibleportion—onlysomuch,thatis,aswouldsufficetoinduceotherstodefendit.Theaggregateoftheseleastpossibleportionsconstitutestherightofpunishment;allthatisbeyondthisisanabuseandnotjustice,afactbutnotaright.[64]Punishments[124]whichexceedwhatisnecessarytopreservethedepositofthepublicsafetyareintheirnatureunjust;andthemorejustpunishmentsare,themoresacredandinviolableispersonalsecurity,andthegreaterthelibertythatthesovereignpreservesforhissubjects.

Achild’ssimplephilosophyofpunishmentthereforeisafterallthecorrectone,whenittellsyouwithouthesitationthatthereasonamanispunishedforabadactionissimply‘becausehedeservesit.’Thenotionofdesertinpunishmentisbasedentirelyonfeelingsofthejusticeofresentment.Sothatthe[83]primaryaimoflegalpunishmentispreciselythesameasmaybeshownhistoricallytohavebeenitsorigin,namely,theregulationbysocietyofthewrongsofindividuals.Inallearlylawsandsocietiesdistincttracesmaybeseenofthetransitionofthevendetta,orrightofprivaterevenge,fromthecontrolofthepersonorfamilyinjuredbyacrimetothatofthecommunityatlarge.Thelatteratfirstdecidedonlythequestionofguilt,whilstleavingitspunishmenttothepleasureoftheindividualsdirectlyconcernedbyit.EventothisdayinTurkeysentencesofdeathformurderrunasfollows:So-and-soiscondemnedtodeathatthedemandofthevictim’sheirs;andsuchsentencesaresometimesdirectedtobecarriedoutintheirpresence.[45]Bydegreesthecommunityobtainedcontrolofthepunishmentaswell,andthusprivatemightbecamepublicright,andtheresentmentofindividualinjuriestheRetributiveJusticeoftheState.

Fromallthathasgonebeforeageneraltheoremmaybededuced,ofgreatutility,thoughlittlecomformabletocustom,thatcommonlawgiverofnations.Thetheoremisthis:‘Inorderthateverypunishmentmaynotbeanactofviolence,committedbyonemanorbymanyagainstasingleindividual,itoughttobeaboveallthingspublic,speedy,necessary,theleastpossibleinthegivencircumstances,proportionedtoitscrime,dictatedbythelaws.’

Aftercrimesofhightreasoncomecrimesopposedtothepersonalsecurityofindividuals.Thissecuritybeingtheprimaryendofeveryproperlyconstitutedsociety,itisimpossiblenottoaffixtotheviolationofanycitizen’srightofpersonalsecurityoneoftheseverestpunishmentsthatthelawsallow.

Againstthisgeneraluncertaintyofpunishment,whichnoseverityinthelawcanaffectormakeupfor,theonlycertaintyofpunishmentdependentonthelawisintheeventofconviction.Buteventhiscertaintyisofaveryqualifiednature,foritdependsonsentimentsofdueproportionbetweenacrimeanditspenalty,whichinnotwomenarethesame.Everyincreaseofseverityinpunishmentdiminishesitscertainty,sinceitholdsouttoacriminalfreshhopesofimpunityfromtheclemencyofhisjudges,prosecutors,orjury.
