Thereseemtobethreeprincipalreasonswhy,underourpresentsystem,crimestillkeepsitsgenerallevel,irrespectiveofallchangesinourdegreesofpunishment.

Thecaseofinfanticidesuggestssimilarthoughts.WhenwerememberthatbothPlatoandAristotlecommendedasavaluablesocialcustomthatwhichwetreatasacrime;whenwerecallthefactthatthelifeofaSpartaninfantdependedonacommitteeofelders,whodecidedwhetheritshouldliveorperish,weshallbetterappreciatethedistancewehavetravelled,or,assomewouldsay,theprogresswehavemade,ifwetakeupsomeEnglishdailypaperandreadofsomehigh-mindedEnglishjudgesentencing,atleastformally,somewretchedwomantodeath,because,inordertosaveherchildfromstarvationorherselffromshame,shehasreleaseditfromexistence.Yetthefeeling,ofwhichsuchasentenceistheexpression,isoftenextolledasoneofthehighesttriumphsofcivilisation;andthelaws,asiftherewerenodifferencebetweenadultandinfant[76]life,gloryinprotectingtheweaknessofachildbytheirmercilessdisregardfortheweaknessofitsmother.
