Themorecruelpunishmentsbecome,themorehumanmindsharden,adjustingthemselves,likefluids,tothelevelofobjectsaroundthem;andtheeverlivingforceofthepassionsbringsitabout,thatafterahundredyearsofcruelpunishments,thewheelfrightensmenonlyjustasmuchasatfirstdidthepunishmentofprison.

NorwasitonlyinEuropethatBeccaria’sinfluencethusprevailed,forassoonastheAmericanColonieshadshakenofftheirEnglishconnectiontheybegantoreformtheirpenallaws.WhentheRevolutionbegantherewereinPennsylvanianearlytwentycrimespunishablebydeath,andwithineighteenyearsofitsclosethepenalcodewasthoroughlytransformed,itbeingordainedin1794thatnocrimeshouldanylongerbecapitalbutmurderinthefirstdegree.ItistruethatthiswasbutareturntotheprinciplesadoptedbyPennonthesettlementofthecolony,butPenn’spenalcodewasannulledbyQueenAnne,andtheEnglishGovernmentinsistedonastrictadherencetothecharterfromCharlesII.,whichenjoinedtheretentionoftheStatuteandtheCommonLawofEngland.When,therefore,thenewConstitutionwasformedin1776,theargumentsofBeccariagavefreshlifetothememoriesofPenn.[25]Thetreatise‘DeiDelitti,’insteadofthrowinganylightonthesubjectofcrimes,oronthemannerinwhichtheyshouldbepunished,tendstoestablishasystemofthemostdangerousandnovelideas,which,ifadopted,wouldgosofarastooverturnlawsreceivedhithertobythegreaterpartofallcivilisednations.

Thelightingofacitybynightatthepublicexpense;thedistributionofguardsinthedifferentquarters;simplemoraldiscoursesonreligion,butonlyinthesilentandholyquietofchurches,protectedbypublicauthority;speechesonbehalfofprivateandpublicinterestsinnationalassemblies,parliaments,orwhereverelsethemajestyofsovereigntyresides—alltheseareefficaciousmeansforpreventingthedangerouscondensationofpopularpassions.ThesemeansareaprincipalbranchofthatmagisterialvigilancewhichtheFrenchcallpolice;butifthisisexercisedbyarbitrarylaws,notlaiddowninacodeofgeneralcirculation,adoorisopenedtotyranny,[221]whicheversurroundsalltheboundariesofpoliticalliberty.Ifindnoexceptiontothisgeneralaxiom,that‘Everycitizenoughttoknowwhenhisactionsareguiltyorinnocent.’Ifcensors,andarbitrarymagistratesingeneral,arenecessaryinanygovernment,itisduetotheweaknessofitsconstitution,andisforeigntothenatureofawellorganisedgovernment.Morevictimshavebeensacrificedtoobscuretyrannybytheuncertaintyoftheirlotthanbypublicandformalcruelty,forthelatterrevoltsmen’smindsmorethanitabasesthem.Thetruetyrantalwaysbeginsbymasteringopinion,theprecursorofcourage;forthelattercanonlyshowitselfintheclearlightoftruth,inthefireofpassion,orinignoranceofdanger.

Assoonastheproofsofacrimeanditsrealityarefullycertified,thecriminalmustbeallowedtimeandopportunityforhisdefence;butthetimeallowedmustbesoshortasnottointerferewiththespeedinessofhispunishment,which,aswehaveseen,isoneoftheprincipalrestraintsfromcrime.Afalsephilanthropyseemsopposedtothisshortnessoftime;butalldoubtwillvanish,onreflectionthatthemoredefectiveanysystemoflawis,thegreaterarethedangerstowhichinnocenceisexposed.
