Thenecessityofremedyingthedisorderscausedbythephysicaldespotismofeachmansinglyproducedthefirstlawsandthefirstmagistrates;thiswastheendandobjectoftheinstitutionofsocieties,andthisendhasalwaysbeenmaintained,eitherinrealityorappearance,attheheadofallcodes,evenofthosethatoperatedotherwise.Buttheclosercontactofmenwithoneanotherandtheprogressoftheirknowledgebroughtaboutanendlessseriesofmutualactionsandneeds,whicheverlaybeyondtheforesightofthelawsandbelowtheactualpowerofindividuals.Fromthisepochbeganthedespotismofopinion,whichaffordedtheonlymeansforobtainingfromothersthosebenefitsandavertingthoseevils,forwhichthelawsfailedtoprovide.Itisthisopinionthatisthetroubleequallyofthewisemanandthefool;thathasraisedthesemblanceofvirtuetohighercreditthanvirtueitself;thatevenmakestherascalturnmissionary,becausehefindshisown[211]interesttherein.Hencethefavourofmenbecamenotonlyusefulbutnecessary,ifamanwouldnotfallbelowthegenerallevel.Hence,notonlydoestheambitiousmanseekaftersuchfavourasusefultohimself,andthevainmangobeggingforitasaproofofhismerit,butthemanofhonouralsomaybeseentorequireitasanecessity.Thishonourisaconditionthatverymanymenattachtotheirownexistence.Bornaftertheformationofsociety,itcouldnotbeplacedinthegeneraldeposit;itisratheramomentaryreturntothestateofnature,amomentarywithdrawalofone’sselffromthedominionofthoselawswhich,underthecircumstances,failtoaffordthesufficientdefencerequiredofthem.

Butthelawsshouldfixacertainspaceoftimebothforthedefenceoftheaccusedandforthediscovery[158]ofproofsagainsthim.Itwouldplacethejudgeinthepositionofalegislatorwereithisdutytofixthetimenecessaryforthelatter.Inthesamewaythoseatrociouscrimes,whosememorytarrieslonginmen’sminds,deserve,whenonceproved,noprescriptioninfavourofacriminalwhohasfledfromhiscountry;butlesserandobscurecrimesshouldbeallowedacertainprescription,whichmayremoveaman’suncertaintyconcerninghisfate,becausetheobscurityinwhichforalongtimehiscrimeshavebeeninvolveddeductsfromthebadexampleofhisimpunity,andthepossibilityofreformmeantimeremainstohim.Itisenoughtoindicatetheseprinciples,becauseIcannotfixapreciselimitoftime,exceptforagivensystemoflawsandingivensocialcircumstances.Iwillonlyaddthat,theadvantageofmoderatepenaltiesinanationbeingproved,thelawswhichshortenorlengthen,accordingtothegravityofcrimes,thetermofprescriptionorofproofs,thusmakingofprisonitselforofvoluntaryexileapartofthepunishment,willsupplyaneasyclassificationofafewmildpunishmentsforaverylargenumberofcrimes.

Itisremarkablethatabookwhichhasdonemoreforlawreformthananyotherbeforeorsinceshouldhavebeenwrittenbyamanwhowasnotalawyerbyprofession,whowastotallyunversedinlegalpractice,andwhowasonlytwenty-sixwhenheattackedasystemoflawwhichhadonitssideallauthority,livinganddead.Humewasnottwenty-sevenwhen[4]hepublishedhis‘TreatiseonHumanNature,’norwasBerkeleymorethantwenty-sixwhenhepublishedhis‘PrinciplesofHumanKnowledge.’ThesimilarprecocitydisplayedbyBeccariaissuggestive,therefore,oftheinquiry,howfarthegreatestrevolutionsinthethoughtsorcustomsoftheworldhavebeenduetowritersunderthirtyyearsofage.

Inthesecondplace,alargeproportionofthehabitualcriminalclassisformedofweak-mindedorimbecilepersons,notoriousfortherepeatedcommissionofpettythefts,crimesofviolenceandpassion,andconfessedtobe‘notamenabletotheordinaryinfluencesofself-interestorfearofpunishment.’[57]Itisnowproposedtoseparatethisclassofprisonersfromothers;butispunishmentoperativeonthematall?Isnottheirproperplaceanasylum?

Suchfatalandlegalisediniquitiesashavebeenreferredtohavebeenapprovedofbyeventhewisestmenandpractisedbyeventhefreestrepublics,owingtotheirhavingregardedsocietyratherasanaggregate[236]offamiliesthanasoneofindividuals.Supposetheretobe100,000individuals,or20,000families,offivepersonseach,includingitsrepresentativehead:iftheassociationisconstitutedbyfamilies,itwillconsistof20,000menand80,000slaves;ifitbeanassociationofindividuals,itwillconsistof100,000citizens,andnotasingleslave.Inthefirstcasetherewillbearepublic,formedof20,000littlesovereignties;inthesecondtherepublicanspiritwillbreathe,notonlyinthemarket-placesandmeetingsofthepeople,butalsowithinthedomesticwalls,whereinliessogreatapartofhumanhappinessormisery.Inthefirstcase,also,aslawsandcustomsaretheresultofthehabitualsentimentsofthemembersoftherepublic—thatis,oftheheadsoffamilies—themonarchicalspiritwillgraduallyintroduceitself,anditseffectswillonlybecheckedbytheconflictinginterestsofindividuals,notbyafeelingthatbreatheslibertyandequality.Familyspiritisaspiritofdetailandconfinedtofactsoftriflingimportance.Butthespiritwhichregulatescommunitiesismasterofgeneralprinciples,overlooksthetotalityoffacts,andcombinesthemintokindsandclasses,ofimportancetothewelfareofthegreaternumber.Inthecommunityoffamiliessonsremaininthepoweroftheheadofthefamilysolongashelives,andareobligedtolookforwardtohisdeathforanexistencedependentonthelawsalone.Accustomedtosubmissionandfearinthe[237]freshestandmostvigoroustimeoflife,whentheirfeelingsarelessmodifiedbythattimidity,arisingfromexperience,whichmencallmoderation,howshalltheywithstandthoseobstaclesinthewayofvirtuewhichviceeveropposes,inthatfeebleandfailingperiodoflifewhendespairoflivingtoseethefruitoftheirlabourshindersthemfrommakingvigorouschanges?
