But,inspiteoftheliberalismoftheCount,thepenallawsandcustomsofLombardyremainedthesame;andthecruellegalprocedurebytortureexistedstill,untouchedbythesalutaryreformseffectedinotherdepartmentsoftheGovernment.Therewasthepreparatorytorture,toextortconfessionfromcriminalsnotyetcondemned;therewastortureforthediscoveryofacriminal’saccomplices;andtherewastheextraordinaryorgreatertorture,whichprecededtheexecutionofasentenceofdeath.Itistruethattorturecouldonlybeappliedtocrimesofacapitalnature,buttherewasscarcelyanactinthepossiblecategoryofcrimesthatwasnotthenpunishablewithdeath.Proofsofguiltweresoughtalmostentirelyfromtortureandsecretaccusations,whilstpenaltiesdependedlessonthetextofanyknownlawthanonthediscretion—thatis,onthecaprice—ofthemagistrate.

TherewaslittleofeventfulnessinBeccaria’slife,andtheonlyepisodeinitofinterestwashisvisittoParisin1766.ThitherheandhisfriendPietrohadbeeninvitedbyMorellet,inthenameofthephilosophersatParis,andthitherhestartedinOctober1766;notwithPietro,whocouldnotleaveMilan,butwithAlessandroVerri,onajourneywhichwastoincludeLondonaswellasParis,andwastooccupyinallaperiodofsixmonths.

Thereseemtobethreeprincipalreasonswhy,underourpresentsystem,crimestillkeepsitsgenerallevel,irrespectiveofallchangesinourdegreesofpunishment.

Butthereisastillfurtheruncertaintyofpunishment,foritisaswellknowninthecriminalworldaselsewherethatthesentencepronouncedincourtisnottherealsentence,andthatneitherpenalservitudefor[96]fiveyearsnorpenalservitudeforlifemeannecessarilyanythingofthesort.Thehumanityofmodernlegislationinsistsonaremissionofpunishment,dependentonaconvict’slifeinthepublicworksprisons,inorderthattheelementofhopemaybrightenhislotandperchancereformhischaracter.Thisremissionwasatfirstdependentsimplyonhisconduct,whichwasperhapstoogenerouslycalledgoodwhereitwashardforittobebad;nowitdependsonhisindustryandamountofworkdone.Yettheelementofhopemightbeotherwiseassuredthanbylesseningthecertaintyofpunishment,say,byassociatingindustryorgoodconductwithsuchlittleprivilegesofdiet,letter-writing,orreceivingofvisits,asstillshedsomeraysofpleasureoverthemonotonyoffelon-life.Itshouldnotbeforgotten,thattheCommissionof1863,whichsostronglyadvocatedtheremissibilityofpartsofpenalsentences,didsoindespiteofoneofitsprincipalmembers,againstnolessanauthoritythantheLordChiefJustice,thenSirAlexanderCockburn.[55]Theveryfactoftheremissibilityofasentenceisanadmissionofitsexcessiveseverity;fortosaythatasentenceisnevercarriedoutistosaythatitneedneverhavebeeninflicted.
