CHAPTERXVIII.INFAMY.

Thistruthis,infact,felt,thoughinaconfusedway,bytheverypersonswhoplacethemselvesfarthestfromit.Foraconfessionmadeundertortureisofnoavailunlessitbeconfirmedbyanoathmadeafterit;andyet,shouldthecriminalnotconfirmhisconfession,heistorturedafresh.Somedoctorsoflawandsomenationsonlyallowthisinfamousbeggingofthequestiontobeemployedthreetimes;whilstothernationsandotherdoctorsleaveittothediscretionofthejudge.

Thelightingofacitybynightatthepublicexpense;thedistributionofguardsinthedifferentquarters;simplemoraldiscoursesonreligion,butonlyinthesilentandholyquietofchurches,protectedbypublicauthority;speechesonbehalfofprivateandpublicinterestsinnationalassemblies,parliaments,orwhereverelsethemajestyofsovereigntyresides—alltheseareefficaciousmeansforpreventingthedangerouscondensationofpopularpassions.ThesemeansareaprincipalbranchofthatmagisterialvigilancewhichtheFrenchcallpolice;butifthisisexercisedbyarbitrarylaws,notlaiddowninacodeofgeneralcirculation,adoorisopenedtotyranny,[221]whicheversurroundsalltheboundariesofpoliticalliberty.Ifindnoexceptiontothisgeneralaxiom,that‘Everycitizenoughttoknowwhenhisactionsareguiltyorinnocent.’Ifcensors,andarbitrarymagistratesingeneral,arenecessaryinanygovernment,itisduetotheweaknessofitsconstitution,andisforeigntothenatureofawellorganisedgovernment.Morevictimshavebeensacrificedtoobscuretyrannybytheuncertaintyoftheirlotthanbypublicandformalcruelty,forthelatterrevoltsmen’smindsmorethanitabasesthem.Thetruetyrantalwaysbeginsbymasteringopinion,theprecursorofcourage;forthelattercanonlyshowitselfintheclearlightoftruth,inthefireofpassion,orinignoranceofdanger.
