Suchconsiderationsasthesewill,perhaps,leadsomedaytotheabolitionofcapitalpunishment.Thefinaltestofallpunishmentisitsefficiency,notitshumanity.Thereisoftenmoreinhumanityinalongsentenceofpenalservitudethaninacapitalsentence,forthemajorityofmurderersdeserveaslittlemercyastheyget.ThemanyoffenceswhichhaveceasedtobecapitalinEnglishlawyieldedlesstoasenseoftheinhumanityofthepunishmentasrelatedtothecrimethantotheexperiencethatsuchapunishmentledtoalmosttotalimpunity.Thebankers,forinstance,whopetitionedParliamenttoabolishcapitalpunishmentforforgery,didso,astheysaid,becausetheyfoundbyexperiencethattheinflictionofdeath,orthepossibilityofitsinfliction,preventedtheprosecution,theconviction,andthepunishmentofthecriminal;thereforetheybeggedfor‘thatprotectionfortheirpropertywhichtheywouldderivefromamorelenientlaw.’
